PaymitaPlus is a product of Mita Technologies Limited (“PaymitaPlus”, “We”, “Us”, “Our”) and serves as a utility and bill payment platform, as well as a provider of virtual dollar card services (collectively referred to as the “Services”). Our Services are securely accessible through the PaymitaPlus Mobile Application (the “App”) and our Website for our users (“you,” “your”).
Purpose of the Agreement
This document contains the terms on which we render our Services to you; and as such is a legally binding agreement made between you and Us. Kindly read through it carefully before using our App or Website to access our Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.
Our Services
Our Services allows you to fund your wallet with us for the purpose of ordering and purchasing utility or products offered by third parties such as mobile airtime, internet data, electricity, cable television subscriptions, waste management, and other utility or products we may include in our Services from time to time.
We also facilitate the purchase and issuance of virtual dollar card services.
All utility or products offered on our App or Website are subject to availability. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.
These Terms
These terms and conditions constitute the entire agreement between you and us regarding your use of our Services and incorporate our Privacy Policy and Cookie Policy by reference. By using our Services, you acknowledge that you have read, understood, and agree to be bound by these terms, the Privacy Policy, and the Cookie Policy.
Registration
You are required to sign up on our App to use our Services. We reserve the right to refuse, remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, similar to an existing username, or otherwise objectionable.
To register, you may be required to supply us identification data like, name, phone number, email address, and we shall verify the information supplied by ourselves or through our third-party services provider.
Know Your Customer (KYC)
In accordance with applicable laws and regulations, we are required by our partner financial services providers (including banks, card processors, payment processors) to verify the information you provide when creating your account. By using our services, you consent to us, either independently or through authorised third-party partners, collecting, verifying, and storing the necessary information provided by you. This may include, but is not limited to, your identity, address, and other personal details. We undertake these measures to fulfill our legal obligations. Failure to provide accurate information or comply with our KYC requirements may result in delays, limitations, or termination of your access to our Services.
Account Security
You agree to keep your password confidential and will be responsible for all use of your account and password. We shall not be liable for any losses or damages arising from your failure to secure your password details, or the device(s) you use to access our Services.
Please be advised to immediately change your password, or any other security-related aspect of your account and reach out to us in the event that:
- Your email address or phone number has been compromised;
- You suspect that your account or log in details has been compromised, or used without your consent; and
- Your transaction history discloses transactions you did not make.
In response to your notification to us, we shall either suspend your account, or restrict the functionality of the account.
Purchase of Services
You can fund your PaymitaPlus wallet through available payment methods on our App or Website, including the Pay with Bank, Card Payment, USSD Payment and such other payment options we shall integrate and make available from time to time.
Once we have received your deposit, we shall fund your PaymitaPlus wallet.
Funding of your wallet is exclusively provided by our partner financial services providers and as such, we disclaim any guarantees of the functionality of any of payment option selected by you nor shall we be responsible for any issues, errors, or delays caused by these partner financial services providers, and when appropriate, we shall restrict or remove a particular payment option at anytime without notice to you.
Each time a request is made to pay for a Service, the corresponding amount will be debited from your PaymitaPlus wallet. It is your responsibility to ensure sufficient funds are available in your wallet before initiating a payment, as transactions will not be processed if the balance is insufficient. PaymitaPlus is not liable for any failed payments due to inadequate wallet balance.
We are not a financial services provider, and as such, funds in your PaymitaPlus wallet are not insured by any deposit protection scheme. However, we take the security of your funds seriously. All customer funds are safeguarded and kept separate from operational expenses. In the unlikely event of bankruptcy, these funds will remain protected and will not be made available to creditors.
You agree that any information you supply to us in relation to your purchase of our Services shall be accurate. After a transaction has been processed using the information supplied by you, we cannot reverse it and we will not be liable whether directly or indirectly for any errors or loss incurred by you as a result of a Service purchase transaction processed by us based on your instructions or information supplied by you.
PaymitaPlus does not provide financial advice. Any information on the platform is for informational purposes only and should not be considered financial advice.
PLEASE NOTE THAT ALL TRANSACTIONS ARE FINAL AND WE SHALL NOT OFFER REFUND FOR COMPLETED TRANSACTIONS.
Disclaimers
PaymitaPlus does not guarantee uninterrupted or error-free access to the Services. Outages, maintenance, or unforeseen issues may occur without prior notice.
Our App and Website including all features, tools, and Services, is provided on an “as-is” and “as available” basis. We make no warranties or representations of any kind, whether express or implied, regarding the availability, reliability, or performance of our App or Website platform, including the accuracy or completeness of content, features, or services. You accept any and all risk arising out of use or performance of the App or software.
We facilitate access to services and products provided by third-party merchants and utility providers through our App or Website. We do not own, operate, or guarantee the quality, functionality, or performance of these third-party products or services. To the fullest extent permitted by the law, we disclaim any liability for failures, malfunctions, or inadequacies of third-party services and you therefore accept all risks associated with the services or product.
Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of profits, data, or goodwill, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising out of or relating to these terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
Indemnity
You agree to indemnify, defend, and hold us harmless, along with our affiliates, partners, officers, directors, employees, and agents, from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of our Services, your violation of this Agreement, non-compliance with relevant laws, or your infringement of any third-party rights.
Termination
This agreement may be terminated when you delete your account.
In our sole discretion we close your account where;
- You fail to comply with this agreement;
- We are required to do so by our partner financial services provider;
- We are required to do so by law or a regulatory authority;
- Your account is linked to a suspicious or fraudulent transaction, money laundering, or any illegal activity
We may equally suspend your account for your safety. When we close your account for any reason, we shall notify you of it and subject to any outstanding obligations we will initiate a refund of the remaining balance to your original payment method, subject to our right to retain any remaining funds in your Wallet to facilitate ongoing investigations, settle any outstanding debts, or comply with legal obligations.
Upon termination, your access to the Website, App, and the Services will cease, and any outstanding obligations will survive termination.
Updates
We may update or modify our App, Website, or Services from time to time to improve functionality, introduce new features, or comply with legal requirements. These updates may occur without prior notice. Failure to download or install any required updates may result in limited functionality or loss of access to our services. We disclaim any liability for any issues, losses, or damages arising from your failure to install or use the latest version of our app or website.
Amendment
We reserve the right to amend this Agreement from time to time and shall notify you if there are any material changes to it via email or a notification on our app. If you continue to use our app after the changes become effective, you agree to be bound by the amended terms.
Severability
If any provision of this Agreement is found to be illegal, invalid or unenforceable, the remaining provisions will remain in full force and effect.
Assignment
You may not assign, transfer, or delegate any of your rights or obligations under these terms without our prior written consent. We reserve the right to assign or transfer our rights and obligations under these terms, in whole or in part, to any third party, without notice to you or your consent.
Dispute Resolution
In the event of any dispute arising out of or relating to these terms, the parties shall first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiation within 15 days, the parties agree to proceed to mediation, which shall be administered by the Oyo State Multi-Door Courthouse. the parties shall mutually appoint a mediator to mediate over the dispute and the cost of mediation shall be equally borne by each party. Where the dispute cannot be resolved after the mediation, the parties may then seek resolution in a competent court of law in Nigeria.
Governing Law
This Agreement will be governed by the laws of the Federal Republic of Nigeria.
